Terms & Conditions – Glass House Films
1. Bookings & Confirmation
All appointments will be confirmed by the Photographer (Glass House Films or Lincoln Berry) prior to attendance.
2. Turnaround Time
Next-day delivery refers to business days only and is subject to availability.
3. Additional Fees
Any additional fees (e.g. travel, editing beyond scope, reshoots) will be communicated and agreed upon before services are undertaken.
4. Client Responsibility
It is the Client’s responsibility to ensure all relevant parties (e.g. vendor, tenant, landlord, property manager) are informed of the appointment time. If the property is unattended or access is not possible, a cancellation fee of 50% of the booking value will apply.
5. Travel Charges
For properties located more than 100km from the Photographer’s base (Central Coast NSW), travel may be charged at up to $0.40/km, with all costs outlined prior to booking.
6. Delivery of Work
All completed work will be supplied electronically via email or download link.
7. Payment Terms
An invoice will be issued within 5 days of service completion unless otherwise agreed. Full payment must be received as per the invoice terms before high-resolution, unwatermarked content is released. No usage rights are granted until full payment is received.
8. Review Period
The Client agrees to review all delivered work and notify the Photographer of any concerns or defects within 5 business days. Beyond this timeframe, the Photographer accepts no responsibility for any issues raised.
9. Access, Safety & Liability
The Photographer must comply with all relevant health and safety laws and will act respectfully while onsite. The Photographer will not be liable for any areas or situations that cannot be photographed due to safety or access restrictions. The Photographer’s liability is limited to the amount paid for the specific service. In the case of unforeseen events (force majeure), the Photographer accepts no liability beyond this. The Client is responsible for ensuring all required permissions, access rights and legal clearances are in place prior to the shoot. The Client agrees to indemnify and hold the Photographer harmless against any claims, damage or legal action arising from access to or presence on the property.
10. Copyright & Usage
All images, videos, floorplans, and graphics created remain the intellectual property of the Photographer. The Photographer retains full copyright and may use the content for promotional purposes including social media, website, or printed marketing. The Client confirms that all individuals appearing in the content have consented to being photographed and used in media. The Client indemnifies the Photographer against any claims relating to the use of these images.
11. Usage Licence
Unless a custom agreement is made, all content is licensed under a standard, individual, non-exclusive licence. This permits use of the photographs, video or other materials only for marketing the specific property for sale or lease. The licence expires once the property is sold, rented, leased, or otherwise removed from the market. The content cannot be resold, sub-licensed, gifted, or transferred in any way. Breach of this agreement will result in the immediate termination of the licence.
12. Termination & Breach
Termination of this agreement does not affect any rights accrued before termination. Breaches of licence or usage terms may result in legal action and revocation of usage rights.
13. Legal Jurisdiction
This agreement is governed by the laws of New South Wales. Any disputes will be resolved in the courts of that jurisdiction.
14. Severability & Waiver
If any part of this agreement is deemed invalid or unenforceable, the remainder shall remain in full force. Delay or failure to enforce any part of this agreement does not waive the right to enforce it later.
15. Satisfaction Guarantee
Glass House Films aims for 100% client satisfaction. Please reach out with any concerns or issues and we’ll do our best to resolve them promptly.
